An Introduction to Civil Mediation

What is Civil Mediation?

Civil mediation is a voluntary and confidential process where an independent mediator helps people involved in a dispute communicate more effectively and explore possible resolutions.

The mediator does not take sides, provide legal advice, or impose decisions. Their role is to manage the process fairly and support constructive discussion.

Civil mediation is commonly used for disputes involving:

  • Neighbours and boundary issues

  • Property or land disagreements

  • Contract or service disputes

  • Personal or community-based disputes

It focuses on understanding concerns, clarifying issues, and identifying practical ways forward.

How civil mediation works

While every case is different, civil mediation typically involves:

  1. An initial conversation to understand the dispute

  2. A discussion about whether mediation is suitable

  3. A structured mediation meeting facilitated by an independent mediator

  4. Exploration of options and possible agreements

The process is designed to be respectful, neutral, and proportionate to the situation.

When civil mediation is most effective

Civil mediation can be particularly helpful when:

  • Communication has broken down

  • The dispute is ongoing or escalating

  • You want to avoid the cost and stress of court proceedings

  • A neutral, independent facilitator is needed

If mediation is not appropriate, this should be discussed openly at the outset.

Thank you for helping us sort out the boundary issues. The process helped us put forward our views and agree outcomes, which is something we have struggled to do for years.

What to expect from the mediation process

While every case is different, mediation usually involves:

  1. An initial conversation to understand the situation

  2. A discussion about whether mediation is appropriate

  3. A structured mediation meeting (or meetings)

  4. A focus on future options and practical outcomes

The process is designed to be respectful, confidential, and proportionate.

Is civil mediation right for your situation?

Mediation may be suitable if:

  • All parties are willing to engage

  • You are seeking a confidential, non-adversarial process

  • You want to explore resolution without escalation

It may not be suitable if:

  • There are immediate safeguarding or legal concerns

  • A court decision is required

  • One or more parties are unwilling to participate

An initial conversation can help clarify suitability.

About the mediator

Civil mediation is facilitated by an independent mediator experienced in managing sensitive and complex disputes.

The mediator’s role is to:

  • Remain impartial

  • Manage the process professionally

  • Ensure all parties are heard

  • Support constructive dialogue
