Commercial Mediation for Business Disputes

Discuss your commercial mediation options with our experts.

What is Commercial Mediation?

Commercial mediation is a flexible and confidential process where a neutral third-party exper, the mediator, is appointed to help businesses resolve a dispute. Unlike a judge or arbitrator, the mediator does not impose a decision but facilitates a conversation, guiding the parties towards a mutually acceptable, commercial settlement.

The process is entirely business-focused, designed to find practical solutions that protect your interests, preserve business relationships, and avoid the immense costs and uncertainty of court proceedings.

Our commercial mediation services can help with:

  • Contractual and supplier disputes

  • Shareholder or partnership disagreements

  • Professional negligence claims

  • Construction and property disputes

  • Intellectual property and copyright issues

Confidential and Without Prejudice
Confidentiality is paramount. Mediation provides a private forum to negotiate openly and explore solutions that would not be possible in a public court. All discussions are conducted on a "without prejudice" basis, protecting your legal position if a settlement isn't reached.

Core Services Explained

MIAM

A MIAM (non-family) is a Mediation Information and Assessment Meeting.

This is conducted on an individual basis with the mediator.

The purposed of this session is to ascertain whether mediation is suitable for the parties to achieve a resolution in their situation.

JOINT CLARITY SESSION

A Joint Clarity Session is a confidentially held meeting (either separately or together) to identify issues, explore options for resolution. It is not a mediation and it is not designed for the parties to agree formal outcomes.

These sessions are particularly useful where one or more parties are unsure about the mediation process and whether to engage with it.

Mediation

Mediation is a neutrally facilitated conversation to help parties narrow issues and agree outcomes that work for them.

Mediation can be held in person or remotely depending on the needs of the parties.

Mediation sessions range from a couple of hours to full days, and for complex matters, multiple sessions or days may be required.

How Our Process Works

Our four-step process is designed for clarity, efficiency, and commercial results.

  1. Initial Enquiry & Consultation: You contact us with the details of the dispute. We conduct a confidential discussion to assess the situation and confirm that mediation is the right path forward.

  2. Pre-Mediation Contact: The appointed mediator engages with each party (and their legal representatives) to understand their commercial objectives and the key issues in the dispute.

  3. The Mediation Session: The mediator brings the parties together for a structured negotiation. This typically involves joint sessions and private, confidential caucuses to explore options and facilitate progress towards a settlement.

  4. Settlement Agreement: Once an agreement is reached, the terms are documented in a legally binding settlement agreement, signed by all parties to formally resolve the dispute.

The Mediation Agency facilitates a structured negotiation where an impartial mediator helps disputing parties to explore the issues, understand the commercial realities, and agree on a legally binding settlement. Our objective is to resolve conflict with minimal disruption, allowing you to focus on running your business.
